XFINITY WIFI TERMS OF SERVICE

Welcome to XFINITY WiFi!

Terms of Service: This XFINITY WiFi service from Comcast is offered as a courtesy to you from XFINITY WiFi and the business hosting this service. If you are currently a Comcast XFINITY Internet subscriber, you may log in and use this service under your XFINITY account. If you are accessing this service from a business that sponsors use by its customers, or this service at this location is otherwise subsidized by an advertiser, you may be permitted to use this service without additional charge. If you are not an XFINITY Internet subscriber, we may require you to receive an advertisement or other informational content, and you may be required to provide certain information in order to access this service for a limited time. Not all locations participate in these campaigns, and not all participating locations will have a sponsored offer running continuously. Certain activities and access may require payment of fees. When that is so, prices will be posted on the sign up page. We reserve the right to change prices and institute new fees at any time, which will be posted on the sign up page.

This WiFi service is made available for your use at your own risk with no warranties. We cannot provide technical support, and remind you that WiFi services by their nature are not inherently reliable or secure. We offer this WiFi service only for personal use. You should not rely on it for critical uses or sensitive information. You are solely responsible for any damages or harm to yourself or anyone else that results from your use of this service or the failure of the service to be available or operate properly. LIABILITY TO YOU UNDER THIS LICENSE, AND YOUR EXCLUSIVE REMEDY FOR ANY LOSS, DAMAGE OR INJURY, REGARDLESS OF THE NATURE THEREOF AND SPECIFICALLY INCLUDING INDEMNITY, BREACH OF CONTRACT, NEGLIGENCE, TORT, AND WARRANTY CLAIMS SHALL NOT EXCEED, AND SHALL BE LIMITED TO, THE FEE PAID BY YOU TO THE PROVIDER(S) OF THIS SERVICE.

Comcast does not exercise control over the Web sites you can access through this service (though the business hosting this service may), whether or not they are affiliated with Comcast, and take no responsibility for any content or services available over the Internet. Please remember you are in a public location and be careful and considerate of other visitors to this venue. Please don’t display offensive material on your screen. Also, of course, you may not use this service for any illegal activity, to harm others, to interfere with the operation of this or other networks or with anyone’s access to or use of the Internet.

As a courtesy service, we or the business hosting it may change, suspend or end this WiFi service at any time, with or without reason, generally or as to specific users. Comcast reserves the right to deny access to users who are not logged in as Comcast Xfinity High Speed Internet customers if they exceed five gigabytes of data throughput and/or fifty sessions per calendar month. If you are an Xfinity High Speed Internet customer signing in with your comcast.net username/password, you will not be subject to these use limits.

If you are a Comcast XFINITY Internet subscriber, you may use this WiFi service without additional charge subject to your subscriber agreements with Comcast, including without limitation the XFINITY Internet Terms of Service, and the Acceptable Use Policy. ANY CLAIM OR DISPUTE BETWEEN YOU AND PROVIDER ARISING UNDER OR IN ANY WAY RELATED TO OR CONCERNING THIS AGREEMENT, AND/OR THE PROVISION TO YOU OF SERVICES OR LICENSED PROGRAMS, SHALL BE SUBMITTED TO FINAL, BINDING ARBITRATION WITH THE AMERICAN ARBITRATION ASSOCIATION (“AAA”) PURSUANT TO ITS PUBLISHED WIRELESS INDUSTRY ARBITRATION RULES, INCORPORATED HEREIN BY THIS REFERENCE AND AVAILABLE BY CALLING THE AAA AT 800-778-7879 OR VISITING ITS WEB SITE at http://www.adr.org/sp.asp?id=22010. Notice of an arbitration commenced by you must be served on Comcast’s agent. An arbitrator may only award as much relief as a court having jurisdiction in the place of arbitration, limited to the same extent that a court would limit such relief and consistent with the provisions of this Agreement. An arbitrator may not order consolidation or arbitration on a classwide basis and may order injunctive or declaratory relief pursuant to applicable law. The arbitral award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own costs in connection with the arbitration; the cost of the arbitrator and the administration of the arbitration shall be borne in accordance with the directive of the arbitral award. YOU ACKNOWLEDGE, UNDERSTAND AND AGREE THAT THIS ARBITRATION PROVISION CONSTITUTES A WAIVER OF ANY RIGHT TO A JURY TRIAL, OR PARTICIPATION AS A PLAINTIFF OR AS A CLASS MEMBER IN A CLASS ACTION.
