COMCAST WIFI TERMS OF SERVICE
A BETA test service for Comcast High-Speed Internet subscribers

Welcome to Comcast WiFi!

This Comcast WiFi service (this “WiFi Service”) is a BETA service for testing and development and may not always be available. We offer this WiFi service as a courtesy to Comcast High-Speed Internet subscribers at selected locations without any additional charge and with no warranties. It is only intended for personal use and should not be relied on for critical uses. And if you are in a public location please remember to be careful and considerate of anyone who might be able to view your screen.

Before you begin using Comcast WiFi, you must read and agree to these Comcast WiFi Terms of Service and the following terms and conditions and policies associated with Comcast High-Speed Internet Service, including any future amendments (collectively, this "WiFi TOS"):

By using this Comcast WiFi Service, you agree to the following terms and conditions (the "WiFi TOS"), a binding agreement between you and Comcast Corporation and its affiliates and Subsidiaries (“Comcast”, “we”, “us”). You represent that you are of legal age to agree to and be bound by this WiFi TOS.

If this WiFi TOS is inconsistent with our general Terms of Service or Privacy Statement, this WiFi TOS shall control as to your use of the Comcast WiFi Service. Nothing in this WiFi TOS shall be deemed to confer any third-party rights or benefits.

If you choose to use other Comcast services while using Comcast WiFi Service, your use will also be governed by the terms and conditions provided to you in association with those services.

You must have a Comcast High-Speed Internet account to use this Comcast WiFi Service. As part of the logon process, you will be asked to provide your Comcast HSI username and password, and you will be responsible for all activities occurring under your username and for keeping your password secure.

Proper Use
The Comcast WiFi Service is a wireless network that allows you to connect to the Internet. You must have a wireless-enabled device to connect to this WiFi Service.

You may use the WiFi Service and related technology provided to you by Comcast for the sole purpose of using the WiFi Service as described here. You must immediately notify us of any unauthorized use of the WiFi Service or any other security breach. We will give you an IP address each time you access the WiFi Service, and it may change. You shall not program any other IP or MAC address into your device that accesses the WiFi Service. You may not use the WiFi Service for any other reason, including reselling any aspect of the WiFi Service. Your use of the Comcast WiFi Service is subject to our Comcast High-Speed Internet Acceptable Use Policy.

Changes In this WiFi TOS and the WiFi Service; Termination
We may modify or terminate the WiFi Service and this WiFi TOS and any accompanying policies, for any reason, and without notice, including the right to terminate with or without notice, without liability to you, access and use of this WiFi Service by you, any user or any third party. Upon any such termination, any and all rights granted by Comcast to you shall terminate. Please review this WiFi TOS from time to time so that you will be apprised of any changes.

WiFi Privacy Policy

Generally

The Comcast Privacy Statement describes how we treat personal information when you use our HSI services, including information provided when you use this WiFi Service. In addition, this section of this WiFi TOS describes privacy practices specific to the Comcast WiFi Service.

You understand and agree that Comcast may access, preserve, and disclose your personal information if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to comply with legal process or protect the rights and property of Comcast or the public.

We do not exercise control over sites that you may visit, or services that you may use, that are not affiliated with Comcast. These other sites and services may place their own cookies or other files on your computer, collect data, or solicit personal information from you. You should read the privacy policies of these sites and services to learn how they handle your personal information.

Comcast reserves the right to monitor, intercept and disclose any transmissions over or using our facilities, and to provide user information, or use records, and other related information under certain circumstances (for example, in response to lawful process, orders, subpoenas, or warrants, or to protect our rights, users or property). Your Security
The Comcast WiFi Service works by transmitting data over the air via radio waves. Wireless Internet access presents challenges for protecting your information from illegal data interception by third parties. You should consult with a computer technician to ensure your computer is configured correctly for secure wireless access to the Internet and that you have the latest security software and hardware installed. Security threats are constantly evolving, so you should regularly check to be sure that your security protection is up to date.

This WiFi Service has a log-in requirement to help protect you against unauthorized use of the service or your other Comcast accounts. This protection does not create a secure session, however, and you should still take other security steps to protect yourself.

Information Collected
Account usage information. You need a Comcast HSI account to use this WiFi Service. We ask for some personal information when you log in to this WiFi Service: your HSI logon and password, which is used to protect your account from unauthorized access.

We may record information about your usage of this WiFi Service, such as when and for how long you use the network and the frequency and size of data transfers. We may collect information about the geographic locations of the Comcast WiFi Service nodes through which you connect to the network.

We use the above information to maintain and study our WiFi network to deliver better service to you. On a regular basis, we delete the above account usage information from our logs.

Your Responsibilities
You understand that this Comcast WiFi Service, which utilizes wireless technologies, is not inherently secure and that wireless communications can be intercepted by technology designed and intended for that purpose. While we use commercially reasonable efforts to provide a secure service, we cannot guarantee the effectiveness of our efforts. We will not be liable to you or any other party for any lack of security that may result from your use of the WiFi Service.

You are responsible for providing security measures that are suited for your intended use of this WiFi Service. For example, you shall take full responsibility for taking adequate measures to safeguard your data from loss. Also, other than the access point technology provided by us, you must provide all equipment, technology and software to use the WiFi Service.

Content Disclaimer
Comcast does not control and is not responsible for data, content, services, or products that you access or download through the Comcast WiFi Service. We may, but are not obliged to, block data transmissions to protect Comcast, the Comcast WiFi network, or the public.

Termination
Comcast reserves the right at any time to terminate your use of this website if you fail to comply in full with any term of this WiFi TOS, or any other terms, agreements, or policies that apply to this WiFi Service and the use of it.

Indemnification
You agree to indemnify, defend, and hold harmless Comcast (including its parents, subsidiaries, and affiliates and all of their respective officers, directors, employees, agents, licensors, suppliers and any third-party information providers) against all claims, losses, expenses, damages and costs (including reasonable attorney fees) resulting from any breach of this WiFi TOS or unauthorized use of the WiFi Service. Your indemnification obligation shall survive your use of the WiFi Service and the termination of this WiFi TOS. At our expense and election, we reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you and you agree to cooperate with Comcast in connection with our defense.

Disclaimer of Warranties and Liability
YOU AGREE THAT YOUR USE OF THIS WIFI SERVICE IS AT YOUR SOLE RISK. BECAUSE OF THE NUMBER OF POSSIBLE SOURCES OF INFORMATION AVAILABLE THROUGH THE WIFI SERVICE, AND THE UNCERTAINTIES OF ELECTRONIC DISTRIBUTION AND WIFI TECHNOLOGY, THERE MAY BE INTERRUPTIONS, DELAYS, OMISSIONS, INACCURACIES, OR OTHER PROBLEMS WITH SUCH INFORMATION. IF YOU RELY ON THIS WIFI SERVICE OR ANY MATERIAL AVAILABLE THROUGH THIS WIFI SERVICE, YOU DO SO AT YOUR OWN RISK. YOU UNDERSTAND THAT YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM ANY MATERIAL AND/OR DATA DOWNLOADED FROM OR OTHERWISE PROVIDED THROUGH THIS WEBSITE.

THIS WIFI SERVICE IS PROVIDED TO YOU "AS IS," "WITH ALL FAULTS," AND "AS AVAILABLE." COMCAST AND ITS AGENTS AND LICENSORS CANNOT AND DO NOT WARRANT THE ACCURACY, COMPLETENESS, USEFULNESS, TIMELINESS, NONINFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF THIS WIFI SERICE OR THE INFORMATION AVAILABLE THROUGH IT, NOR DO WE GUARANTEE THAT THE WIFI SERVICE WILL BE ERROR-FREE, OR CONTINUOUSLY AVAILABLE, OR THAT THE WIFI SERVICE WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

UNDER NO CIRCUMSTANCES SHALL COMCAST (INCLUDING ITS PARENTS, SUBSIDIARIES, AND AFFILIATES) OR ITS AGENTS OR LICENSORS BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DAMAGES ARISING OUT OF ANY USE OR MISUSE OF THIS WIFI SERVICE, INCLUDING, WITHOUT LIMITATION, LIABILITY FOR CONSEQUENTIAL, SPECIAL, INCIDENTAL, INDIRECT, OR SIMILAR DAMAGES, EVEN IF ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES, REGARDLESS OF THE FORM OR CAUSE OF ACTION INCLUDING, BUT NOT LIMITED TO, CONTRACT, NEGLIGENCE, AND OTHER TORT ACTIONS. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN CATEGORIES OF DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH STATES, THE LIABILITY OF COMCAST AND ITS AGENTS AND LICENSORS IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW. Miscellaneous
By using this WiFi Service, you agree to abide by these terms and policies. We may change these terms and policies from time to time. By continuing to use this WiFi Service after we post any changes, you accept and agree to those terms and policies, as modified.

This WiFi TOS agreement has been made in and shall be construed in accordance with the laws of the Commonwealth of Pennsylvania. By using this WiFi Service, you consent to the exclusive jurisdiction of the state and federal courts in Philadelphia, Pennsylvania, in all disputes arising out of or relating to this WiFi TOS agreement or this WiFi Service. If any portion of this WiFi TOS agreement is held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties and the remainder of the provisions shall remain in full force and effect.

By using this WiFi Service, you agree to abide by the terms of this WiFi TOS agreement. We hope you enjoy using this WiFi Service, and we welcome suggestions for improvements.
